Peak Saunas – Terms and Conditions of Sale

 

 

1. Definitions

a. "Seller" refers to Peak Saunas Ltd, the provider of the sauna product.
 b. "Buyer" refers to the individual or entity purchasing the sauna product.
 c. "Product" refers to the sauna unit and any accompanying accessories or components.
 d. "Residential Use" refers to use by private individuals in a personal, non-commercial setting, not open to the public or used for income-generating services.

 

 

2. Product Description

a. The Seller will provide a description of the sauna product, including specifications, dimensions, and features, either on its website or in printed materials.
 b. The Buyer is responsible for reviewing all product information and ensuring the product meets their requirements prior to purchase.

 

 

3. Pricing and Payment

a. Prices are as specified at the time of purchase and are stated in New Zealand Dollars (NZD).
 b. Payment must be made in full before the product is dispatched or made available for collection.
 c. The Seller reserves the right to change prices at any time without notice. This does not affect confirmed and paid orders.

 

 

4. Orders and Delivery

a. Orders may be placed online via the Peak saunas website, by phone, or in person.
b. The Seller will make reasonable efforts to deliver within the specified timeframe; however, delays may occur due to availability, shipping schedules, or external factors.
 c. The Buyer is responsible for providing accurate delivery information and any special delivery instructions.
 d. Delivery delays or issues will be communicated to the Buyer as soon as reasonably practicable.

 

 

5. Installation and Assembly

a. The Buyer is responsible for the correct installation and assembly of the sauna product unless otherwise specified.
 b. The Seller may offer professional installation services at an additional cost. Any such services will be governed by a separate agreement.

 

 

6. Warranty

a. All sauna products are covered by a limited warranty, the terms of which form part of these Terms and Conditions and are provided to the Buyer at time of purchase and available on the Seller’s website.
 b. Warranty coverage varies by product and component type.
 c. The Buyer must follow all usage, maintenance, and installation guidelines to retain warranty eligibility.
 d. Peak Saunas may require proof of proper installation and maintenance when processing warranty claims.

 

 

7. Pre-Orders & Deposit Policy

a. For sauna units not held in stock, a non-refundable deposit is required. Where cancelled, Peak Saunas may retain this deposit to the extent permitted by law to recover reasonable costs incurred (e.g., freight, handling, storage, restocking).
 b. Deposits for in-stock saunas located in New Zealand are refundable prior to dispatch.
 c. A 50% deposit of the total order value is required to reserve stock or secure a future production slot. Deposits below 50% may not guarantee allocation and could result in delays.
 d. Full and final payment is required 48 hours prior to dispatch. Failure to pay in full may result in rescheduling of delivery.

 

 

8. Returns and Refunds

a. Returns or exchanges may be accepted within the conditions of the Seller’s Return Policy, subject to approval.
b. Products must be returned in like-new condition, including all components and original packaging.
c. The Buyer is responsible for return shipping costs unless otherwise agreed.
d. Products cannot be returned due to a change of mind unless the 60-Day Satisfaction Guarantee applies.

 

 

60-Day Satisfaction Guarantee

To qualify for a return under this policy, the following conditions must be met:

1. The purchaser must be the original buyer (non-transferable).
   
2. The sauna must be in like-new condition, defined as: no visible wear, water damage, stains, cracks, or structural damage, as assessed by Peak Saunas or an authorised agent.
   
3. The sauna must be free of liens, encumbrances, or claims.
   
4. At least 30 days must have passed since delivery.
   
5. The sauna must pass a full inspection prior to refund approval.
   
6. The Buyer must provide written notice of their intent to return.
   
7. All removal and return freight are the responsibility of the Buyer.
   
8. The refund will exclude the original delivery charge and any labour fees incurred.
   

Note: This guarantee applies only to the purchase of new saunas. Other products are excluded.

 

 

9. Limitation of Liability

a. The Buyer agrees to use the product in accordance with provided instructions and acknowledges the inherent risks of sauna use.
b. To the extent permitted by New Zealand law, Peak Saunas, its agents, or employees will not be liable for:

• Loss of income or profits
  
• Property damage not caused by negligence or breach
  
• Personal injury unless caused by proven negligence or product defect
  
• Indirect, incidental, or consequential damages
   c. If products are purchased for business purposes, the Consumer Guarantees Act 1993 (CGA) does not apply.
   d. Peak Saunas is not liable for any general advice regarding local council regulations (e.g., building/resource consents). The Buyer is responsible for confirming compliance with their local authority.
   e. Peak Saunas is not liable for additional costs arising from:
  
• Site preparation or alterations
  
• Delivery access issues
  
• Missed delivery appointments
  
• Labour for removal or reinstallation
  

 

 

Force Majeure

Peak Saunas shall not be liable for any failure or delay in performance caused by events beyond its reasonable control, including but not limited to:Acts of God, natural disasters, pandemics, transportation interruptions, supply chain disruptions, labour strikes, fire, war, terrorism, or government restrictions.

 

 

10. Privacy Policy

Your personal information is stored securely and will not be shared with third parties without your consent. Please refer to our website for the full Privacy Policy.

 

 

11. Damages or Loss in Transit

a. All products must be inspected upon delivery. Visible damage to packaging must be noted on the freight carrier’s consignment note at the time of receipt.
b. Any internal or concealed damage must be reported to both the freight carrier and Peak Saunas within 24 hours of delivery.
c. Peak Saunas is not liable for property damage caused during delivery or installation unless due to direct negligence.

 

 

12. Commercial Use

Unless otherwise agreed in writing, products are sold for residential use only. Any commercial, rental, or promotional use (including advertising or subletting) requires the express written consent of Peak Saunas.

 

 

13. Governing Law

a. These Terms and Conditions are governed by the laws of New Zealand.
b. Any disputes must first be submitted to MBIE mediation services. If unresolved, either party may escalate the matter to the New Zealand courts.

 

 

14. Agreement

By placing an order, the Buyer acknowledges and agrees to these Terms and Conditions.

For online orders, clicking “Place Order” or submitting payment constitutes acceptance of these Terms.
